Definitions
- In these Terms, the following words have the following meanings:
- Access Hours: Hours when access to the Unit is permitted.
- Agreement: These Terms and the Unit Licence Agreement.
- Authorised Person: Someone authorised by You to access the Unit or Facility.
- Business Day: Any day except Saturday, Sunday, or Public Holiday.
- Commencement Date: Date specified in the Unit Licence Agreement.
- Contents: Items stored in the Unit during this Agreement.
- Deposit: Amount specified in the Unit Licence Agreement as security.
- Due Date: Payment date specified in the Unit Licence Agreement.
- Contents Protection: Additional liability for Contents as described.
- Normal Perils: Specific risks such as fire, theft, flood, etc.
- Our Fees: Fees payable by You, as specified in the Unit Licence Agreement.
- Prompt Payment: Payment made on the Due Date.
- Facility: Premises where the Unit is located.
- Termination Date: Date of termination of the Agreement.
- Unit: The specified storage unit.
- Unit Licence Agreement: The document executed between You and Us.
- We, Us, Our: Birmingham Self-storage.
- Website: www.birminghamselfstorage.uk.
- You, Your: The customer. Access to the Facility
- Only You and Authorised Persons can access the Unit. You are responsible for their actions and must provide proof of identity. Access may be denied if identity is not verified or for safety reasons. Use of the Unit
- You are granted a licence to:
- Use the Unit for storage only.
- Access the Unit during Access Hours for specific purposes.
- Changes to Access Hours will be notified in advance, except in emergencies. Relationship
- We do not take possession of the Contents and are not responsible for them. Locks
- You are responsible for Your keys and locks. Only one padlock is allowed. Our Rights to Enter
- We may enter the Unit:
- With notice for inspections or repairs.
- Without notice for emergencies, legal requirements, or suspected breaches. Ownership
- You confirm the Contents are owned by You or stored with permission. You indemnify Us against claims regarding ownership. Refusal of Access
- We may refuse access if safety or security is at risk. Prohibited Items
- You must not store:
- Perishable items, plants, animals, flammable materials, weapons, chemicals, illegal items, and high-value items without prior agreement. Prohibited Activities
- You must not:
- Cause nuisance, use the Unit as living space, sell items, make alterations, use power supplies without approval, or cause damage. Responsibilities
- You must:
- Use the Facility responsibly, maintain the Unit, inform Us of changes, and follow rules and regulations. Relocation
- We may require You to move Contents to another unit or facility with notice. If You do not comply, We may move them at Our cost. Payments
- You must pay Fees on the Due Date. Deposit Return
- Deposits will be returned after termination, less any deductions for unpaid fees or damages. Fee Changes
- We may change Fees with notice. You can terminate the Agreement if You do not agree. Late Payments
- Late payments incur additional charges:
- A late payment fee of £12 or 12.5% of the rental charge (whichever is greater) will be applied if payment is not received on the Due Date.
- If payment is not made within 30 days, an additional £100 administration charge and a £20 collection charge will be added. Consequences of Non-payment
- We are not responsible for Contents during periods of non-payment. We may deny access and eventually sell the Contents to recover the debt. Suitability of Unit
- You must ensure the Unit is suitable for Your Contents. Unit sizes are approximate. Insurance
- We do not insure Contents. You must have insurance against Normal Perils. If you do not have Contents Protection, you are responsible for any loss or damage to your Contents. Our Liability
- Our liability is limited. We are not responsible for business losses or unforeseeable damages. Your Liability
- You indemnify Us for any claims arising from Your use of the Unit. Force Majeure
- We are not liable for delays or failures due to circumstances beyond Our control. Termination
- The Agreement can be terminated by either party with notice. Upon termination, You must remove all property and leave the Unit clean. Post-Termination
- After termination, any remaining property may be disposed of. Refunds will be issued for overpayments, less any deductions. Inspection
- You must inspect Contents upon removal and report any loss or damage immediately. Data Use
- Our use of Your data is detailed in Our Privacy Policy on Our Website. General Provisions
- These provisions apply to the Agreement:
- Delay in exercising rights is not a waiver.
- Invalid provisions do not affect the validity of others.
- Changes to the Agreement must be in writing.
- You cannot assign rights without Our consent.
- The Agreement does not confer rights on third parties.
- The Agreement is governed by English law.
- Notices must be in writing.
- Disputes may be resolved through informal conciliation before court proceedings. Additional Conditions and Information Cardholder Authorisation for Payment of Fees
- Our Responsibilities:
- Process payments from provided card details.
- Debit the correct fees and charges.
- Keep payment information confidential.
- Your Responsibilities:
- Provide authorised payment card details.
- Ensure payments can be collected.
- Inform Us of any changes to payment details.
- Provide alternative payment methods if necessary. Facility Rules
- Considerate Behaviour:
- Do not block corridors or obstruct doors.
- Park in designated areas.
- Return trolleys to the provided areas.
- Minimise noise.
- Do not dispose of waste at the Facility.
- Prohibited Storage Items:
- Explosives, hazardous materials, illegal items, cash, and perishable items.
- High-value items unless agreed in writing.
- Unacceptable Activities:
- No smoking, eating, or drinking in storage areas.
- No animals, except registered assistance dogs.
- Children must not be left unattended.
- Securing Your Unit:
- Always lock Your unit door with Your padlock.
- Barriers:
- Operate barriers with a PIN code.
- Do not tailgate or drive through without entering Your PIN.
- Security Measures:
- CCTV and alarms are in place for security.
- Do not obstruct gates or sensors.
- Emergency Assistance:
- Emergency phones and intercoms are available.
- Staff are available during office hours for assistance.
- Fire Precautions:
- Familiarise Yourself with fire procedures and exits.
- Follow evacuation procedures in case of fire.
- Use of Lifts:
- Do not use lifts during emergencies.
- Lighting:
- Controlled by sensors or staff.
- First Aid:
- First aid boxes are available at the Facility.
- Trolleys and Moving Property:
- Use trolleys considerately.
- Do not overload or misuse trolleys.
- Support for Customers with Disabilities:
- Notify staff of any disabilities for assistance.
- Reporting Suspicious Activity or Damage:
- Report concerns to staff immediately.
- Recovery of Costs:
- We may recover costs for damage caused by You or Your agents.
- Notifying Us of Changes:
- Inform Us immediately of changes to personal or payment details.
- Additional Services:
- Additional services may incur charges.
- Forklifting:
- Only operated by trained staff.
- Collections and Deliveries:
- Can be arranged with prior notice.
- Office Services:
- Scanning and photocopying are available.
- Use of Electricity:
- Electrical items require prior permission.
- Moving Out:
- Provide 7 days’ notice. Leave the unit clean and remove Your padlock. Contents Protection
- Applicability:
- Applies only if You have paid for Contents Protection.
- Our Contents Protection:
- We accept liability for specified risks if You have paid the fee and complied with the Agreement.
- Limit of Liability:
- Limited to the replacement value of Contents, subject to a £150 deductible.
- Notifying Us of Loss or Damage:
- Inform Us within 24 hours of discovery. Complete a claim form and provide requested information.
- Limitation and Exclusion of Liability:
- Our total liability is limited to £35,000, with lower limits for specific items.
- Expiry and Termination:
- Contents Protection terminates with the Agreement.
